These Terms of Service apply to the use of the platform BYKERS.APP (hereinafter 'Platform'), operated by justcrew UG (haftungsbeschränkt) (hereinafter 'Provider').
By registering and using the Platform, you accept these Terms. Deviating conditions are not recognized unless the Provider expressly agrees to their validity in writing.
BYKERS.APP is a free online platform for motorcyclists with the following features:
The use of most features requires a free registration. You can register via email or Google login.
You must be at least 18 years old to use BYKERS.APP. By registering, you confirm that you are of legal age.
You are obligated to provide truthful information during registration and to keep your access data secret. You are liable for all activities that occur under your user account.
Each person may only create one user account. Multiple accounts are not permitted.
The Provider reserves the right to suspend or delete user accounts in case of violations of these Terms or the Community Guidelines.

The platform, including design, logos, texts, and software, is protected by copyright. All rights belong to the Provider or the respective rights holders.
Content that you upload (images, texts, routes) remains your property. However, you grant the Provider a non-exclusive, worldwide, free license to use the content to provide the platform and to promote BYKERS.APP itself (e.g. in app store screenshots or on our own social media channels).
You may only use routes and content from other users within the scope of platform functions. Commercial use without consent is prohibited.
The Provider is liable without limitation for damages resulting from injury to life, body or health based on a negligent or intentional breach of duty, as well as for other damages based on an intentional or grossly negligent breach of duty.
In the case of slightly negligent breach of essential contractual obligations (cardinal obligations) whose fulfillment is necessary for the proper performance of the contract and on whose observance the user regularly relies, the Provider's liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded.
The above limitations of liability do not apply in the case of fraudulently concealed defects, where a guarantee has been assumed, or for claims under the Product Liability Act.
The Provider assumes no warranty for the accuracy, completeness or timeliness of user-generated content. Route suggestions – in particular AI-generated routes – are non-binding, algorithmically created suggestions and may contain errors. The user is obliged to check routes and road conditions on their own responsibility before setting off and to comply with road traffic regulations. The responsibility for the safe execution of a tour lies solely with the user.
The Marketplace contains affiliate links to partner companies (in particular through the AWIN and Webgains networks as well as through Stay22 for accommodation offers). For purchases or bookings made through these links, the Provider receives a commission.
Affiliate links are marked accordingly. The commission has no influence on the purchase price for you.
The Provider is not a contractual partner for purchases made through affiliate links. The terms and conditions and privacy policies of the partners apply to their products and services.
Users may post their own listings (e.g. contact and classified ads). BYKERS.APP provides only the technical platform for this.
Contracts for offered goods or services are concluded exclusively between the participating users. The Provider does not become a party to the contract and assumes no warranty for the existence, accuracy, quality, legality or fulfilment of the offers, nor for the identity of the users.
The marketplace is intended exclusively for private users (C2C). Commercial offers are prohibited. Also prohibited are listings for illegal, dangerous, counterfeit or non-marketable goods, as well as for safety-relevant parts without valid approval.
Contact details of other users obtained via listings may be used solely to initiate the respective transaction and not for advertising.
Users can report illegal listings or listings that violate these terms via the reporting function. Reported content is reviewed by human moderators. If the Provider removes a listing, it informs the affected user of the reasons and offers the opportunity to comment (internal complaint procedure pursuant to Art. 20 DSA). The criteria for moderation, removal and account suspension are transparently set out in the Community Guidelines (Art. 14 DSA).

You can export, correct, or delete your data at any time.
The Provider strives to keep the platform available at all times. However, constant availability cannot be guaranteed.
The Provider reserves the right to change, expand, or discontinue the platform at any time without notice.
The Provider may change these Terms with a notice period of at least 4 weeks. Changes will be communicated to users via email or in-app message. If you object within the notice period, you may terminate the agreement. Users must expressly agree to the amended Terms for them to take effect.
You can delete your user account at any time in the settings. The Provider can terminate the user relationship with a notice period of 14 days. In case of serious violations, immediate termination is possible.
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
Should individual provisions of these Terms be invalid, the validity of the remaining provisions remains unaffected.
